Drops Lawsuit – Blames poor judgment.

Too late.
The local Tea Party has already started to plan your retirement.
Integrity and honor is about who you are, not something you do based on polls.

(Original) Scenario…

House under construction.
Front door locked.
Prospective buyer arrives to view property.
Alone.
No Builder representative present.
Prospective buyer finds front door locked, but is undeterred.
He walks around the property and tries all the doors until he finds a door to the basement unlocked.
Decides that the unlocked door is an invitation by the builder to enter without permission.
(that’s trespassing, y’all, by definition)
Prospective buyer notes that the stairs to the next floor are non-existent.
Also notes that there is a ladder that reaches the next floor.
At this point, he jumps the gap from trespasser to idiot and climbs the ladder to the next floor landing.
Correction… attempts to climb.
Apparently, he is not well versed in the art of climbing a ladder – insert comments, if you will, about pasty, soft-handed pencil-pushing types who have no common sense when operating in the real world – slips, and falls.

Breaking a leg.

Now, of course, there had to be an ambulance, hospital visit, surgery, insurance, this and that… and, when it was all said and done the builder did not press charges.  Nor did the owners of the house.  Yes, the house was already sold.  The brand-new owners of the house thought the prospective buyer/perpetrator had suffered enough with the fall and thought they would show mercy.  A very gracious act, if you ask me…
Story over, right?

Time passes… exactly three years to be exactly exact.

(long enough for the statue of limitations on prosecution for trespassing/breaking and entering to expire)
At this point our plucky prospective buyer/perp/forgiven trespasser/idiot/pasty, soft-handed pencil-pushing type decides to sue the builder and the, at that time, just-purchased homeowner for damages and responsibility for his actions of that day.

In a brief by the jerk’s lawyer is the complaint that -

“the premises were not reasonably safe.”

So, to put this all in perspective…

The plucky prospective buyer – perp – forgiven trespasser – idiot – pasty, soft-handed pencil-pushing type who happens to be a United States Senator affiliated with the Republican Party… Senator Jim Alesi of New York…

1. Arrives at an in-construction home-site.
2. Chooses to break in after finding the front door locked.
3. Chooses to climb a ladder from the basement to the next floor because there are no stairs.
4. Slips and falls off the ladder because of his inexperience in climbing ladders and possibly wearing improper footwear.
5. Breaks his leg in the process.
6. Prays for forgiveness with no prosecution for his stupid choices – gets it. ( just guessing the prayer part)
7. Waits 3 years until he cannot be prosecuted for his stupid choices.
8. Immediately files a lawsuit blaming the builder and homeowner for not stopping him, a  Senator of the United States who should know better, from breaking and entering/trespassing, for not stopping him from climbing the ladder, for not providing a soft place for his worthless behind to land on when he fell, and for the pain and suffering his own choices brought him.

The brief argues that he was forced to climb the ladder because there was no functional staircase in the UNFINISHED home, which pointed to negligence on the part of the builder and the people who had just bought the house, concluding that his injuries, brought on by his previous choices, were not his fault.

A. This is total BS.
B. This man has no honor.  He’s suing constituents that chose not to press charges on him.
C. I hope the judge presiding is a common-sense man or woman.
D. I’m embarrassed for the good people of the state of New York.
E. RINO (Republican In Name Only) Senator Jim Alesi appears to have given us a perfectly good reason for voting him out of office.

I say good riddance.
There’s got to be a conservative in the NY(55) Senate District that can replace him.
New York Tea Party Movement… find that person.
